पार्टनर शर्तें

1. सामान्य प्रावधान

1.1. ये Partner Terms moto-asia.com के उस उपयोग को नियंत्रित करती हैं, जहाँ व्यक्ति listings, profiles, motorcycle rental offers या अन्य services प्रकाशित करते हैं, website के माध्यम से clients से communicate करते हैं और clients आकर्षित करने के लिए website का उपयोग करते हैं।

1.3. partner account register करके, listings प्रकाशित करके, chat का उपयोग करके, client inquiries प्राप्त करके या partner के रूप में वेबसाइट का किसी भी तरीके से उपयोग करके, partner इन Terms और वेबसाइट की Terms of Use की स्वीकृति की पुष्टि करता है।

2. पार्टनर की स्थिति

2.1. partner अपने नाम से, अपने risk पर और अपनी responsibility के तहत कार्य करता है।

2.2. partner वेबसाइट Administrator का employee, agent, representative या branch नहीं है।

2.3. वेबसाइट Administrator partner और client के बीच arrangements का पक्षकार नहीं है, payments स्वीकार नहीं करता, funds hold नहीं करता, deposits स्वीकार नहीं करता, और किसी भी party द्वारा performance की guarantee नहीं देता।

3. लिस्टिंग्स और प्रोफाइल के संबंध में पार्टनर की जिम्मेदारियाँ

3.1. partner को केवल accurate, current और non-misleading information प्रकाशित करनी होगी।

3.2. partner निम्न के लिए पूर्ण रूप से स्वयं जिम्मेदार है:

• motorcycle या अन्य service के अस्तित्व और वास्तविक availability के लिए;
• price, rental terms, restrictions, deposit, insurance, document requirements और handover तथा return procedures की correctness के लिए;
• vehicle की technical condition, safety, operation की legality और completeness के लिए;
• उस स्थान पर, जहाँ service प्रदान की जाती है, आवश्यक rights, permits, licenses, insurance, registrations और अन्य documents के अस्तित्व के लिए;
• local laws, traffic rules, consumer protection requirements, tax obligations और अन्य mandatory rules के compliance के लिए।

3.3. यदि terms, price, availability, photos या अन्य material information बदलती है, तो partner को listing data तुरंत update करनी होगी।

3.4. photos, texts, descriptions, logos और अन्य materials प्रकाशित करके partner पुष्टि करता है कि उन्हें उपयोग और प्रकाशित करने के लिए उसके पास सभी आवश्यक rights हैं।

4. Clients के साथ communication

4.1. partner client को दिए गए सभी messages, promises, representations, offers और arrangements के लिए अकेले जिम्मेदार है:

• वेबसाइट की built-in chat के माध्यम से;
• phone पर;
• messengers में;
• email से;
• offline personal communication के दौरान।

4.2. partner द्वारा client के साथ agreed कोई भी terms, partner की client के प्रति obligations हैं और वे वेबसाइट Administrator पर कोई obligations नहीं बनातीं।

4.3. यदि partner chat और automatic translation का उपयोग करता है, तो उसे समझना होगा कि machine translation inaccurate हो सकती है। deal के सभी material terms को partner को अतिरिक्त रूप से साफ wording में check और confirm करना होगा।

4.4. partner को निम्न करने की अनुमति नहीं है:

• spam, flooding, threats, insults, extortion, fraud या unlawful activity के लिए chat का उपयोग करना;
• automatic translation का दुरुपयोग करना या chat या translation systems पर artificial load बनाना;
• website rules का उल्लंघन करते हुए chat के माध्यम से links, malicious code, dangerous technical data या अन्य materials भेजना;
• स्वयं को वेबसाइट का representative, deal का guarantor या ऐसा व्यक्ति बताना जिसके पास वास्तव में वह authority नहीं है;
• ऐसा data publish या transmit करना जिसके लिए partner के पास lawful rights नहीं हैं।

5. रिव्यू और प्रतिष्ठा

5.1. partner समझता है और स्वीकार करता है कि users उसके account के साथ अपने interaction के बारे में reviews छोड़ सकते हैं।

5.2. Administrator अपनी discretion से reviews और ratings को moderate, hide, delete, publication से मना या sort कर सकता है।

5.3. Administrator सभी reviews के publication की guarantee नहीं देता और किसी specific review को publish, hide या delete करने के बारे में partner से coordinate करने के लिए बाध्य नहीं है।

6. पार्टनर content का लाइसेंस

6.1. वेबसाइट पर listings, texts, photos, images, logos और अन्य materials प्रकाशित करके partner Administrator को ऐसा content store, reproduce, adapt, display, publish और अन्यथा उपयोग करने के लिए simple, non-exclusive, royalty-free license देता है, जितना वेबसाइट के operation, moderation, cards के display, service promotion और complaint handling के लिए आवश्यक हो।

7. मॉडरेट और ब्लॉक करने का अधिकार

7.1. Administrator अपनी discretion से, और जहाँ applicable law अन्यथा आवश्यक न हो, बिना prior notice और बिना reasons दिए भी निम्न कर सकता है:

• partner registration या access से इनकार करना;
• किसी भी listing, profile, message, image, review या अन्य material के display को hide, delete या limit करना;
• chat, translation, profile या अन्य functions को restrict या disable करना;
• partner account को temporarily suspend या permanently block करना।

7.2. ऐसी measures के grounds में users की complaints, inaccurate information के संकेत, legal violations, security risks, bad-faith conduct, service के लिए reputational risks, operational reasons और अन्य कोई भी circumstances शामिल हो सकते हैं जिन्हें Administrator material मानता है।

8. प्लेटफ़ॉर्म की ओर से कोई guarantees नहीं

8.1. Administrator partner को निम्न की guarantee नहीं देता:

• traffic, leads, contacts या bookings की कोई specific volume;
• errors या downtime के बिना uninterrupted website availability;
• किसी specific search position, ranking या results placement का preservation;
• किसी listing, profile, review या message का publication, display या retention।

9. पार्टनर की liability

9.1. partner clients, authorities और third parties के प्रति निम्न के लिए पूरी तरह और अकेले responsible है:

• listing और profile content;
• offered services की legality;
• information की accuracy;
• प्रदान की गई motorcycle या service की quality और safety;
• clients के साथ किए गए promises, arrangements और communications;
• उस स्थान पर local requirements और mandatory rules का compliance, जहाँ service प्रदान की जाती है।

9.2. यदि partner की actions, listings, content, promises या violations के कारण Administrator के खिलाफ claims, demands, lawsuits, fines, losses या अन्य sanctions लाई जाती हैं, तो partner Administrator को संबंधित losses, जिनमें reasonable legal defense costs भी शामिल हैं, के लिए compensate करेगा।

10. पार्टनर उपयोग की समाप्ति

10.1. partner किसी भी समय website का उपयोग बंद कर सकता है, लेकिन इससे clients के प्रति पहले से ग्रहण की गई obligations या website use period के दौरान किए गए violations की responsibility समाप्त नहीं होती।

11. लागू कानून और विवाद

11.1. ये Terms Russian Federation के laws द्वारा governed हैं।

11.2. court जाने से पहले, partner को info@moto-asia.com पर claim भेजनी होगी। claim review period Administrator के उसे प्राप्त करने की तारीख से 30 calendar days है।

11.3. यदि claim procedure के माध्यम से dispute resolve नहीं होता, तो उसे Administrator के place of residence पर Russian Federation के court में लाया जाएगा, जब तक mandatory applicable law अन्यथा न कहे।

12. Terms में परिवर्तन

12.1. Administrator किसी भी समय इन Partner Terms में amendment कर सकता है।

12.2. नया version वेबसाइट पर publish होते ही effective हो जाता है, जब तक उस version में कोई अलग date न दी गई हो।

12.3. नए version के publication के बाद partner द्वारा वेबसाइट का continued use updated Terms की acceptance माना जाएगा।
